Among the types of Personal Data that this Application collects, by itself or through third parties, there are: Cookies; Usage Data; various types of Data; email address; geographic position; shopping history; unique device identifiers for advertising (Google Advertiser ID or IDFA, for example); first name; last name; phone number; payment info; billing address; shipping address; website; Data communicated while using the service; Universally unique identifier (UUID); device information; number of Users; session statistics; city; country; User ID; IP address; session duration; scroll-to-page interactions; clicks; time zone; mouse movements; interaction events; page events; custom events; layout details; positional information; password.

Complete details on each type of Personal Data collected are provided in the dedicated sections of this privacy policy or by specific explanation texts displayed prior to the Data collection. Personal Data may be freely provided by the User, or, in case of Usage Data, collected automatically when using this Application.

Unless specified otherwise, all Data requested by this Application is mandatory and failure to provide this Data may make it impossible for this Application to provide its services. In cases where this Application specifically states that some Data is not mandatory, Users are free not to communicate this Data without consequences to the availability or the functioning of the Service.

Users who are uncertain about which Personal Data is mandatory are welcome to contact the Owner. Any use of Cookies — or of other tracking tools — by this Application or by the owners of third-party services used by this Application serves the purpose of providing the Service required by the User, in addition to any other purposes described in the present document and in the Cookie Policy.

Users are responsible for any third-party Personal Data obtained, published or shared through this Application.

Mode and place of processing the Data

Methods of processing

The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data. The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Application (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Owner at any time.

Place

The Data is processed at the Owner's operating offices and in any other places where the parties involved in the processing are located. Depending on the User's location, data transfers may involve transferring the User's Data to a country other than their own. Retention time

Unless specified otherwise in this document, Personal Data shall be processed and stored for as long as required by the purpose they have been collected for and may be retained for longer due to applicable legal obligation or based on the Users' consent.

Data deletion

Submit a request at app.orionsleep.com/delete-my-account. Enter the phone number and email address on your account.

You can also email support@orionsleep.com with the subject line “Data deletion request.” Include the email address or phone number on your account, and an order number if you have one, so we can locate your data.

We may retain information where the law requires us to, or where we need it to finish a transaction you asked for, prevent fraud, resolve a dispute, or enforce our agreements. If we cannot delete something you asked us to remove, we will tell you why and how long we will keep it.

Research and De-Identified Data

Orion may store Personal Data, including biometric and sleep-related data such as temperature and heart rate, whether collected directly or imported from connected devices and health platforms. This stored data may remain associated with you.

Before sharing any of this data with researchers, including those from academic, scientific, and medical institutions, for sleep, health, and longevity research, Orion de-identifies it so that it cannot reasonably be linked back to you.

Oura Data

If you connect an Oura account via direct integration, we collect the Oura data you authorize, which may include sleep (such as duration, stages, and scores), readiness, heart rate, heart rate variability, body temperature, blood oxygen, respiratory rate, and activity. We store and share this data as described in “Methods of processing” and “Place” above, and use it to provide our service. Upon request, we will delete all data collected through the direct Oura-to-Orion integration (this does not include Oura data we receive through separate third-party connections); follow the steps under “Data deletion” above.

SMS and Text Messaging Privacy

When you opt in to receive text messages from Orion Sleep, we collect your mobile phone number and your messaging consent status. This information is used solely to send you the text messages you have consented to receive and to manage your messaging preferences.

We do not sell, rent, share, or disclose your text messaging consent, opt-in data, or mobile phone number to any third parties or affiliates for their own marketing or promotional purposes. This includes any information collected as part of SMS, MMS, or RCS opt-in processes.

Your messaging consent and phone number may only be shared with service providers who assist us in delivering text messages (such as our messaging platform provider), and only to the extent necessary to fulfill the messaging service. These service providers are contractually prohibited from using your information for any purpose other than delivering messages on our behalf.

Users Outside the United States

Orion is based in the United States, and our website, products, and services are intended for and directed to individuals in the United States. We do not offer or market our products or services to individuals in the European Economic Area (“EEA”) or the United Kingdom or otherwise direct our activities to individuals in those jurisdictions.

Our website and certain services may remain accessible to individuals who are temporarily or permanently located outside the United States, including individuals who purchased our products or began using our services while in the United States and later travel or relocate abroad. Such accessibility or continued provision of services does not mean that Orion offers or markets its products or services to individuals in those jurisdictions or intentionally monitors their behavior.

If you access our website or use our services from outside the United States, your personal information may be transferred to, stored, and processed in the United States and other jurisdictions in which we or our service providers operate, subject to applicable law.
